My husband bought me a used van financing denied 60 days later, do they have to refund our down payment?

We bought the car on 4/5/08, the engine blew on 4/6/08. They took 4 weeks to fix it, under the warranty we purchased. Now it is 2 monthes later and they say the financing was denied and we will have to sign a new contract and pay $560.00 more down in addition to the $2350.00 we already paid, and that both of our names have to be on the contract. They put it in his name only because the payments came out cheaper. They say if we return the van they will only refund us $300.00 of the down payment we paid. Can they do this? What are our rights, anyone know? From what I read the seller can not change the contract without us agreeing. Oh yeah we live in California.

Should state Dealer or Seller is to be yeld to contract as is Buyer...





If you sign a contract


READ THEM BEFORE YOU SIGN THEM





Go back read contract


Does it state , Down payment might be raised or increased


Does it state , Contract is void ? For any reasons ?





Call Lawyer .... Take your contract and have them read it over.

NO .. They can%26#039;t. See a lawyer immediately. They damaged you because they committed fraud to the financing institution when they left you off the application. Sounds like you are being taken for a ride.





The dealer is absolutely at fault for this and has damaged you. At the minimum this is a contract based on a %26quot;false premise%26quot;, default of the law is a complete %26quot;recinsion%26quot; of the deal. That means you get back every dime, the proceeds you paid in and any %26quot;trade in%26quot; vehicle as well.





Do not give them the car, do not give them another penny, call a good lawyer immediately. You probably can own the car free and clear due to the damage they did to you.
